1. Introduction

This privacy policy ("Policy") describes how Scriptwood Inc, a corporation incorporated in the United States ("Scriptwood", "we", "us" or "our"), collects, protects and uses the personally identifiable information ("Personal Information") you ("User", "you" or "your") may provide on the www.scriptwood.com website and any of its products or services (collectively, "Website" or "Services").

This Policy also describes the choices available to you regarding our use of your Personal Information and how you can access and update this information. This Policy does not apply to the practices of companies that we do not own or control, or to individuals that we do not employ or manage.

2. Collection of Personal Information

We receive and store any information you knowingly provide to us when you create an account, publish content, make a purchase, fill any online forms on the Website, invite collaborators, or contact support. When required this information may include your email address, name, phone number, billing address, or other Personal Information. You can choose not to provide us with certain information, but then you may not be able to take advantage of some of the Website's features. Users who are uncertain about what information is mandatory are welcome to contact us.

3. Script and Creative Content

When you use Scriptwood, you may upload or create scripts, concepts, coverage materials, rewrite history, notes, comments, chat messages, and exports ("Creative Content"). Creative Content may contain sensitive unpublished intellectual property and is treated as user-provided content, not as Personal Information unless it identifies you or another individual.

We store Creative Content to provide the Services, including generating coverage, AI rewrites, consultant chat, collaboration, sharing, and downloads. Creative Content is associated with your account and retained according to your use of the Services and our retention practices described below.

We do not use your scripts or Creative Content to train our own foundation models. Creative Content is processed solely to deliver the Services you request.

4. Collection of Non-Personal Information

When you visit the Website our servers automatically record information that your browser sends. This data may include information such as your device's IP address, browser type and version, operating system type and version, language preferences or the webpage you were visiting before you came to our Website, pages of our Website that you visit, the time spent on those pages, information you search for on our Website, access times and dates, and other statistics.

5. Managing Personal Information

You are able to access, add to, update and delete certain Personal Information about you. The information you can view, update, and delete may change as the Website or Services change. When you update information, however, we may maintain a copy of the unrevised information in our records. Some information may remain in our private records after your deletion of such information from your account.

When you delete your account or specific Creative Content, we will delete or de-identify such data within a reasonable period, except where we must retain it to comply with legal obligations, resolve disputes, enforce our agreements, maintain security, or complete pending processing. Backup copies may persist for a limited period before being overwritten.

We may use any aggregated data derived from or incorporating your Personal Information after you update or delete it, but not in a manner that would identify you personally. Once the retention period expires, Personal Information shall be deleted. Therefore, the right to access, the right to erasure, the right to rectification and the right to data portability cannot be enforced after the expiration of the retention period.

6. Use and Processing of Collected Information

Any of the information we collect from you may be used to personalize your experience; improve our Website; improve customer service and respond to queries and emails of our customers; process transactions; send notification emails such as password reminders, updates, etc.; run and operate our Website and Services; and provide script coverage, AI features, collaboration, sharing, and export functionality. Non-Personal Information collected is used only to identify potential cases of abuse and establish statistical information regarding Website usage. This statistical information is not otherwise aggregated in such a way that would identify any particular user of the system.

We may process Personal Information related to you if one of the following applies: (i) you have given your consent for one or more specific purposes; (ii) provision of information is necessary for the performance of an agreement with you and/or for any pre-contractual obligations thereof; (iii) processing is necessary for compliance with a legal obligation to which we are subject; (iv) processing is related to a task that is carried out in the public interest or in the exercise of official authority vested in us; or (v) processing is necessary for the purposes of the legitimate interests pursued by us or by a third party, such as operating and securing the Services. 7. AI Processing

To provide coverage, AI rewrites, script chat, and consultant features, we transmit relevant Creative Content and prompts to third-party AI infrastructure providers acting as our subprocessors. This processing occurs solely to generate the output you request and operate the Services.

AI providers may temporarily process your Content in secure cloud environments. We configure our AI subprocessors not to use your scripts or Creative Content to train their general-purpose foundation models, subject to their applicable terms and service settings.

AI chat and rewrite history may be stored in your account so you can review prior sessions. You should not submit information in chat that you do not want processed for the requested feature.

8. Collaboration and Sharing

If you invite collaborators or create share links, the Creative Content you choose to share will be visible to those collaborators or link recipients according to the permissions you set. Collaborator email addresses and activity metadata may be processed to manage invitations, permissions, and comments.

You are responsible for deciding what to share and with whom. We are not responsible for disclosure caused by share links you distribute or collaborators you invite.

9. Subprocessors

We use trusted third-party service providers to operate the Services. These providers may process Personal Information and Creative Content on our behalf, including:

  • Cloud hosting and database providers
  • AI and machine learning infrastructure providers
  • Payment processors
  • Email and customer communication providers
  • Analytics and security providers

We require subprocessors to handle data only as necessary to provide services to us and subject to appropriate confidentiality and security obligations. A current list of subprocessors may be requested by contacting support@scriptwood.com.
